Article 1 – Definitions
In these Terms and Conditions, the following definitions apply:
- Cancellation Period: The period within which the consumer may exercise their right to cancel.
- Consumer: A natural person who is not acting in the exercise of a profession or business and who enters into a distance contract with the trader.
- Day: Calendar day.
- Ongoing Transaction: A distance contract concerning a series of products and/or services, with a delivery and/or purchase obligation spread over time.
- Durable Medium: Any tool that enables the consumer or trader to store information addressed to them personally, in a way that allows for future reference and unchanged reproduction of the stored information.
- Right of Withdrawal: The option for the consumer to cancel the distance contract within the cancellation period.
- Trader: A natural or legal person who offers products and/or services to consumers at a distance.
- Distance Contract: A contract in which, as part of an organized system for the distance sale of products and/or services by the trader, only one or more means of distance communication is used up to and including the moment the contract is concluded.
- Means of Distance Communication: Tools that can be used for concluding a contract without the consumer and trader meeting simultaneously in the same place.
- Terms and Conditions: These General Terms and Conditions of the trader.

Article 3 – Applicability
These Terms and Conditions apply to every offer from the trader and every distance contract or order between the trader and the consumer. Before the distance contract is concluded, the text of these Terms and Conditions is made available to the consumer. If this is not reasonably possible, a notification will be given before the distance contract is concluded, explaining where the Terms and Conditions can be reviewed and that they will be provided free of charge at the consumer’s request.
If the contract is concluded electronically, the text of these Terms and Conditions can be made available electronically before the distance contract is concluded, allowing the consumer to easily store them on a durable medium. If this is not reasonably possible, a notification will specify where the Terms and Conditions can be reviewed electronically and that they will be provided at the consumer’s request.
In cases where specific product or service conditions apply in addition to these Terms and Conditions, the second and third paragraphs apply accordingly, and the consumer may rely on the applicable provision that is most favorable in case of conflicting conditions.
If any provision of these Terms and Conditions is nullified or annulled, the contract and the remaining Terms and Conditions will continue to apply. The affected provision will be replaced by a provision that approaches the original intention as closely as possible.
Situations not covered by these Terms and Conditions should be evaluated in accordance with the spirit of these Terms and Conditions.
Any lack of clarity regarding the interpretation or content of one or more provisions will be interpreted in accordance with the spirit of these Terms and Conditions.
Article 4 – The Offer
If an offer is subject to a limited validity period or conditions, this will be explicitly stated. The offer is non-binding, and the trader is entitled to amend and adjust the offer.
The offer contains a complete and accurate description of the products and/or services offered. The description is sufficiently detailed to allow the consumer to make a good assessment of the offer. Images are a true representation of the offered products and/or services. Apparent mistakes or errors in the offer are not binding on the trader.
All images, specifications, and information in the offer serve as indicators and cannot form the basis for any claim for damages or dissolution of the contract.
Images of products are a true representation of the offered products. The trader cannot guarantee that the displayed colors exactly match the actual colors of the products.
Every offer includes information making clear to the consumer what rights and obligations are associated with accepting the offer, including but not limited to:
- The price, exclusive of any import duties and VAT. These additional charges are the responsibility of the customer and are applied by the post and/or courier service upon import into the EU. The post and/or courier service collects VAT (and potentially other import charges) from the recipient.
- Shipping costs, if applicable.
- The manner in which the contract will be concluded and which actions are necessary.
- Information about the right of withdrawal.
- Payment, delivery, and execution of the contract.
- The time frame for accepting the offer, or the period for which the trader guarantees the price.
- The tariff for remote communication, if the cost of using the means of distance communication is calculated based on a rate other than the regular base rate.
- Whether the contract is archived, and if so, how the consumer can consult it.
- How the consumer can verify and, if desired, correct information provided in the contract before concluding it.
- Any additional languages in which the contract may be concluded besides English.
- Codes of conduct to which the trader has adhered and how the consumer can consult them electronically.
- The minimum duration of the distance contract in case of an ongoing transaction.

Article 5 – The Contract
The contract is concluded when the consumer accepts the offer and complies with the conditions thereof.
If the consumer has accepted the offer electronically, the trader will immediately confirm receipt of the acceptance electronically. As long as the trader has not confirmed receipt, the consumer may dissolve the contract.
If the contract is concluded electronically, the trader will take appropriate technical and organizational measures to secure electronic data transmission and ensure a safe online environment. If the consumer is able to pay electronically, the trader will take appropriate security measures.
The trader reserves the right to check within legal limits whether the consumer can meet their payment obligations, as well as any other facts and factors relevant to responsibly concluding the distance contract. If the trader has sound reasons not to enter into the contract based on this inquiry, they are entitled to refuse an order or attach special conditions to its execution.
The trader will send the consumer the following information in writing or in a way that allows the consumer to store it on a durable medium:
- The business address where the consumer can submit complaints.
- Conditions under which the consumer can exercise their right of withdrawal, or a clear statement if the right of withdrawal does not apply.
- Information about warranties and existing after-purchase services.
- Data included in Article 4, paragraph 3, of these conditions, unless the trader has already provided this information to the consumer before executing the contract.
- Conditions for terminating the contract if it is of indefinite duration or exceeds one year. In the case of an ongoing transaction, this information will be provided only for the first delivery.
Every contract is concluded under the condition that the relevant products are available.
Article 6 – Right of Withdrawal
When purchasing products, the consumer has the option to cancel the contract within 14 days without stating reasons. This reflection period begins the day after the consumer, or an appointed third party, has received the product.
During the reflection period, the consumer will handle the product and packaging carefully, only unpacking or using it to the extent necessary to assess whether they wish to keep it. If they exercise their right of withdrawal, they will return the product with all accessories and, if possible, in its original condition and packaging, according to the trader’s instructions.
The consumer can also declare their withdrawal through a model withdrawal form or another clear statement. If the consumer wants to use the model withdrawal form, they may do so by notifying the trader.
Article 7 – Costs in Case of Withdrawal
If the consumer exercises their right of withdrawal, they bear the return shipping costs. The trader will refund all payments received, including delivery costs, within 14 days of withdrawal.
The trader will refund the consumer all received payments, including delivery costs incurred by the consumer for the product's return. However, the trader may wait to refund until they have received the product back, or the consumer has provided proof of return, whichever occurs first.
Article 8 – Exclusion of the Right of Withdrawal
The trader can exclude the consumer’s right of withdrawal if this was explicitly stated in the offer. Exclusion of the right of withdrawal is only valid if the trader clearly stated this in the offer, and the consumer was informed before concluding the contract.
Article 9 – Prices
During the offer’s validity period, prices for the offered products and/or services will not be increased, except for price changes due to statutory regulations.
If there is an error in the offer’s price that was not stated, the trader may cancel the order or apply special conditions.
Article 10 – Conformity and Guarantee
The trader guarantees that the products and/or services conform to the contract, the specifications in the offer, and the requirements of usability and reliability. If the trader offers additional guarantees beyond those required by law, this will be communicated clearly.
Article 11 – Delivery and Execution
The trader will handle orders with the greatest care. Orders will be processed in the order in which they are received unless otherwise agreed.
The trader will deliver ordered products within 30 days if possible, unless a longer period has been agreed. The trader will notify the consumer of any delay in delivery.
Article 12 – Payment
Payments are due immediately upon contract conclusion unless otherwise agreed. The consumer is obligated to inform the trader promptly of any inaccuracies in payment details.
Article 13 – Complaints
The trader has a complaint procedure and will respond to complaints within 14 days of receipt. If a complaint cannot be resolved, the consumer may submit it to:
- The relevant consumer protection authority;
- An arbitration board.
Article 14 – Applicable Law
These terms and conditions, and any disputes arising therefrom, are governed by the laws of the country in which the trader is established.
